1. Introduction
Welcome to Cheflink ("the Platform"). These Terms and Conditions govern use of the Platform by restaurants, bars, cafés, and other food and beverage establishments (hereinafter "Venue" or "Professional User"), as well as by end guests who place orders via QR codes (hereinafter "Guests").
By accessing or using Cheflink, you agree to be bound by these Terms and Conditions.
2. Definitions
- Platform: the Cheflink software (including the web interface, admin panel, and QR ordering pages).
- Venue / Professional User: a business that uses Cheflink to receive orders and manage table tabs.
- Guest: a person who places orders via QR codes generated by the Venue using Cheflink.
- Account: a profile or access credential assigned to a Venue or its authorized staff.
- Services: all features offered by Cheflink.
3. Scope of Service
Cheflink provides a technology tool for Venues to manage QR orders, table tabs, and kitchen order flow. Cheflink:
- Does not sell, prepare, or deliver food or beverages.
- Is not a party to the commercial relationship between the Venue and the Guest.
- Does not set prices or sales terms for products offered by the Venue.
4. Accounts and Access
- To use the Platform as a Venue, you must create an account with accurate, complete, and current information.
- You are responsible for maintaining the confidentiality of your credentials.
- The Venue is responsible for managing access for authorized staff and revoking access when appropriate.
- Cheflink may suspend or cancel access in cases of misuse or violation of these Terms.
5. Acceptable Use
- Use the Platform in accordance with applicable law and these Terms.
- Do not attempt unauthorized access to systems, accounts, or data belonging to others.
- Do not alter, copy, distribute, or reverse-engineer Cheflink's software without express permission.
- Do not use Cheflink for illegal or fraudulent activities.
6. Venue Responsibilities
- Correctly configure the menu, prices, service charges, taxes, and any discounts.
- Review and fulfill orders received through the Platform in a timely manner.
- Clearly inform Guests about any special conditions.
- Comply with local regulations on consumer protection, food safety, and data privacy.
- Verify that tab calculations and additional charges are correct before charging the Guest.
7. Pricing, Plans, and Payments
Cheflink may offer free and paid plans for Venues. Unless otherwise stated:
- Prices may be expressed in the Venue's local currency or another agreed currency.
- Charges are billed per period and are non-refundable once the period has begun.
- We may update prices in the future with reasonable advance notice to the Venue.
8. Intellectual Property
Cheflink, including its source code, design, interfaces, and brand, is the property of the Platform owner or its licensors and is protected by intellectual property laws.
The Venue retains all rights to its own content (e.g., restaurant name, logos, dish photos, menu descriptions) and grants us a limited license to display that content within the Platform while the service is active.
9. Privacy and Data Protection
The processing of personal data for Guests and Venues is governed by our Privacy Policy, which forms part of these Terms. The Venue agrees to use Guest data only for purposes related to order management and business operations.
10. Availability, Maintenance, and Changes
Cheflink strives to keep the Platform continuously available but does not guarantee the absence of temporary interruptions due to maintenance, updates, or technical issues.
11. Limitation of Liability
To the extent permitted by applicable law, Cheflink is not liable for:
- Losses arising from errors in the Venue's price, menu, or charge configuration.
- Guest claims related to product quality, delivery times, or billing errors.
- Indirect, incidental, special, or consequential damages.
12. Changes to These Terms
We may update these Terms from time to time. Continued use of Cheflink after the effective date of any changes constitutes acceptance of the updated Terms.
13. Governing Law and Jurisdiction
